These Terms of Service govern your use of Pricemist's price tracking service. By accessing our service, you agree to these Terms. If you disagree with any part, you must cease using the service.

2. Our Service

THE SERVICE IS PROVIDED ON AN AS IS AND AS AVAILABLE BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Pricemist helps you track product prices from various online retailers through our proprietary monitoring technology. We provide:

• Price monitoring and alerts within subscription limits
• Historical price data and trend analysis
• Price drop notifications and alerts
• A browser extension for saving products directly from retailer websites

Important Disclaimers:

Price Accuracy: We cannot guarantee that displayed prices will be available when you visit retailer websites. Price information is subject to constant change by retailers.

Data Accuracy: There is no guarantee that our price information will be accurate and current. We accept no liability for any inaccuracy or unavailability.

Third-Party Relationships: We are not affiliated with, endorsed by, or responsible for any third-party retailers or websites. We do not control their terms, policies, or business practices.

3. Your Account

Account Registration

You must provide accurate, complete, and up-to-date information when creating your account. Keep your login details secure and notify us immediately of any security breaches. You are fully responsible for all account activity, whether authorized or unauthorized, until you notify us of a breach.

Account Security and Usage

Keep your login details secure and don't share them with others outside your household. Accounts are intended for personal use. Product tracking limits apply per account regardless of the number of users.

Account Termination

You may cancel your subscription at any time through your account settings. We may suspend or terminate accounts that violate these terms, with notice when possible. We reserve the right to suspend or terminate your account for violations, fraudulent activities, or misuse, at our sole discretion.

4. Subscription Plans and Pricing

4.1 Service Tiers

We offer two subscription tiers with different product tracking limits and features:

• Free Tier: Limited product tracking suitable for casual users
• Plus Tier ($9/month): Enhanced product tracking limits and advanced features for power users

4.2 Payment Terms

Subscription fees are billed monthly in advance according to your selected plan and auto-renew until canceled. Prices are subject to change with 30 days' notice for existing subscribers via the service or email. Failed payments result in immediate account suspension. You may upgrade or downgrade your plan at any time, with changes effective at the next billing cycle.

4.3 Affiliate Commissions

We may earn commissions from retailers when users make purchases through tracked product links. This affiliate relationship does not affect the prices you pay or influence our price tracking accuracy.

6. Acceptable Use

Permitted Uses

You may use our service for personal price tracking purposes within your subscription limits, provide accurate information during registration, respect our systems by not attempting to overload them, and comply with applicable laws and regulations.

Prohibited Uses - You may not:

• Use the service unlawfully or for illegal purposes
• Impersonate others or provide false information
• Share your account credentials with others outside your immediate household
• Use shared accounts for commercial or business purposes
• Circumvent product tracking limits through multiple accounts
• Employ unauthorized automated tools (e.g., bots, scrapers) without prior written consent
• Attempt to reverse-engineer, decompile, or discover the source code of our proprietary technology
• Use our service to create competing platforms
• Engage in any activity that could harm our service, other users, or our reputation

7. User Content and Responsibilities

You are solely responsible for the legality and appropriateness of any content you provide and must ensure any product URLs you track comply with applicable laws. You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of our service, violation of these terms, or infringement of third-party rights.

Content License

By posting content to our service, you grant us a worldwide, non-exclusive license to use, modify, and distribute such content for service-related purposes.

8. Our Intellectual Property

The Pricemist service, including our proprietary monitoring technology, algorithms, data compilations, and trademarks, represents our intellectual property. We retain ownership of our content, features, and functionality. While you're welcome to use our service, please respect our ownership rights by not copying, modifying, or redistributing our technology.

9. Service Reliability and Limitations

Our Commitment

We work to provide reliable service but cannot guarantee perfect uptime or data accuracy due to factors beyond our control:

• Changes to third-party websites or retailer policies
• Internet connectivity issues
• Technical failures of third-party systems
• Maintenance requirements
• Anti-bot measures implemented by retailers

Force Majeure

We are not responsible for service interruptions caused by circumstances beyond our reasonable control, including third-party website modifications, technical failures, changes in retailer policies, government actions, or natural disasters.

10. Liability Limitations

Service Basis

Our service is provided "as is" without warranties. We cannot guarantee specific outcomes or perfect accuracy.

Liability Scope

To the maximum extent permitted by EU law, our total liability shall not exceed €50 or the amount you paid in the preceding 3 months, whichever is lower.

Excluded Damages

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to:

• Lost profits or business interruption
• Missed purchase opportunities or trading losses
• Loss of data or business information
• Reputation damage
• Third-party claims

Time Limits

Any claims must be brought within 6 months of the incident to ensure timely resolution.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by us to be effective.
